Terms of Use

The Aglaïa Jewellery online shop is aimed exclusively at consumers. According to the Consumer Protection (Fair Trading) Act (Cap 52A), a "consumer" is an individual who: (a) Receives or has the right to receive goods/services from a supplier; or (b) Has a legal obligation to pay a supplier for goods/services that have been or are to be supplied to another individual;

The present Terms of Use apply to all purchase transactions and contracts concluded via the Aglaïa Jewellery online shop between Aglaïa Jewellery and the consumer.

In all cases, it is the version of the Terms of Use available on Aglaïa Jewellery website, and hence considered valid, at the time of concluding the contract that is decisive. ​

Upon concluding the order process by activating the checkout with "PayPal" button, the consumer bindingly declares offer to purchase the goods selected (order); Aglaïa Jewellery will immediately confirm receipt of the order by e-mail using the e-mail address provided by consumer. The receipt confirmation is not a binding acceptance of the order; it can however be linked with an explicit acceptance declaration. We are entitled to accept the contract offer included in the order within three working days following receipt. We will accept the order by means of an e-mail confirmation or by dispatching the ordered goods. The purchase contract is only concluded by means of this acceptance. We are entitled to reject the order; for example, after checking credit worthiness. In this case, we will inform the consumer of the rejection by e-mail.

After concluding the entry and prior to the binding dispatch of the order by means of activating the checkout with "Paypal" button, all the order details will be displayed; here, the consumer have the opportunity to correct entry errors.

The price given on the Aglaïa Jewellery online shop at the time the order is placed is binding. The price includes the respectively valid taxes, if applies. 

​

A price offered within the context of special offers is exclusively limited to the special campaign. Special campaigns are always indicated as such.

Aglaïa Jewellery reserve the right to sell goods in common household quantities and sell while supplies last only.

Any delivery charges apply will be displayed prior to concluding the order process. The consumer will be informed of the binding period within which we will dispatch the goods in the event of the acceptance of order (delivery time) during the course of the ordering process. The delivery time begins on the working day following receipt of full payment. If, for reasons for which the consumer is responsible, the goods cannot be delivered, additional shipping charges will apply in the event of redelivery. In these cases, the shipping and return costs will be borne by the consumer. No cancellation is allowed once the order has been delivered, regardless of arrival.

Payment of goods is fundamentally possible by means of PayPal; The payment types concretely available will be displayed during the ordering process.

Aglaïa Jewellery reserves the right to reclaim bonus products granted without legal obligation in case preconditions for granting such bonus product should not or no longer be fulfilled. Precondition for granting a bonus product is that the purchase contract continues to exist in the amount of the minimum order value. If the consumer return all or part of the goods, for example by exercising consumer right of return, and consequently fall below the minimum order value, then the consumer will, also retrospectively, no longer be granted a bonus product for that purchase. In such case please send the bonus product together with the return of goods back to us. Should the consumer however wish to purchase the bonus product instead, please contact us via Contact Us page directly.

The consumer is entitled to cancel the order within 1 calendar day without providing a reason. The cancellation period is 1 calendar day from the date of order paid. To exercise consumer right of cancellation, we must be informed through the Contact Us page of your decision to cancel this order. To observe the cancellation period, it is sufficient to send us notification of the exercising of the right of cancellation prior to the expiry of the cancellation period.

Goods finished in accordance with customer specifications or goods which have been clearly tailored to the personal requirements of the consumer (i.e. engraved items) are non-returnable. All engraved items of jewellery are specifically for final sale and have been engraved according to customer specifications. Aglaïa Jewellery is not liable for errors that are the result of customer instructions or specifications.

Upon acceptance of cancelling the order, Aglaïa Jewellery will return all payments received for the order, including delivery costs (with the exception of additional costs arising as a result of the consumer choosing a different form of shipping to the standard, less expensive shipping offered by us), if any. We will process the refund no later than 14 business days from the day on which we receive notification of cancellation of the order. For this repayment, we will use the same means of payment used during the original transaction, unless otherwise explicitly agreed with the consumer; under no circumstances will the consumer be charged fees for this repayment.

The right of the consumer to offset counter-claims shall only exist if these counter-claims are uncontested or have been ascertained to be legally binding. the consumer can only assert the right of retention if the counter-claim is based on the same contract relation. Aglaïa Jewellery are neither obligated to participate in a dispute-resolution procedure in front of a consumer arbitration board, nor are we willing to do so. This policy describes how we may collect and use personal information, and the rights and choices available to our visitors and users regarding such information.

We strongly urge our users to read and make sure to fully understand and agree with our Data Protection Policy before accessing or use our website. This Data Protection Policy constitutes a binding and enforceable legal contract between Aglaïa Jewellery and our users, so by accessing and/or using any of our services, this signify and affirm an informed consent to this Data Protection Policy, including to the collection and processing of personal information.​ Only information entered while visiting our online shop or transmitted to us in any other way is collated, saved and processed. Aglaïa Jewellery may share personal information with third parties (or otherwise allow them access to it) only in the following manners and instances:

Aglaïa Jewellery may contact users and customers to notify account-related information, to troubleshoot problems, to resolve a dispute, to collect fees or monies owed, to poll opinions through surveys or questionnaires, to send updates about Aglaïa Jewellery, or as otherwise necessary to contact to enforce our User Agreement, applicable national laws, and any agreement made. For these purposes we may contact via email, telephone, text messages, and postal mail.

Aglaïa Jewellery has security measures designed to protect the personal information shared with us, including physical, electronic and procedural measures and HTTPS secure access to most areas on our services; the transmission of sensitive payment information (such as a credit card number) through our designated purchase forms is protected by an industry standard SSL/TLS encrypted connection; and we regularly maintain a PCI DSS (Payment Card Industry Data Security Standards) certification. However – regardless of the measures and efforts taken by Aglaïa Jewellery, we cannot and do not guarantee the absolute protection and security of personal information, or any other User Content uploaded, published or otherwise shared with Aglaïa Jewellery or anyone else.

The data collect from site visitors within the European Economic Area (“EEA”) may also be transferred to and processed in a country outside of the EEA. Any such transfer of personal data will be carried out in compliance with applicable laws. For transfers outside the EEA, Aglaïa Jewellery will use Standard Contractual Clauses and Privacy Shield as safeguards for countries without an adequacy decision from the European Commission. Aglaïa Jewellery never pass on, sell or swap data for marketing purposes to third parties outside the Alpine Quantum Group, the parent company of Aglaïa Jewellery. Data that is forwarded to third parties (such as Wix), is only used to provide you with our services.

Please note that permanently deleting account erases all information from Aglaïa Jewellery databases. After completing this process, user or customer can no longer use account-related activities. As all its data will be removed permanently, Aglaïa Jewellery will not be able to restore account or retrieve personal data in the future. If you contact Aglaïa Jewellery support in the future, the system will not recognise account and support agents will not be able to locate the deleted account.
